  • TILMA

    In Progress Ecojustice prepared a legal opinion on the potential environmental impacts of TILMA, the Trade, Investment and Labour Mobility Agreement between Alberta and BC that came into force on April 1, 2007. The agreement prohibits measures by governments in Alberta and BC (including municipalities) that discriminate against corporations and individuals in the other province and includes broad rules that prohibit these governments from restricting or impairing investment. TILMA does contain some exemptions for environmental matters such as for water, forests, fish, wildlife, and for the management of hazardous and waste materials. However, measures to reduce greenhouse gas emissions and protect endangered plants outside of forests do not have adequate protection under TILMA. In September 2007, the Union of BC Municipalities passed a resolution calling on the province to amend TILMA to exclude local municipalities, or to scrap the agreement altogether.
