US EPA Transboundary Air Pollution Complaint

A complaint filed under the US Clean Air Act regarding transboundary air pollution from US coal plants


On June 17, 2005, Ecojustice filed a petition with the US Environmental Protection Agency under Section 115 of the US Clean Air Act alleging that carbon dioxide, nitrogen oxides, sulphur dioxide, and particulate (PM2.5) emissions from US coal fired plants are endangering the health or welfare of Canadians by causing smog, acid rain, and climate change in Canada. If the petition is successful, the US EPA would have to require individual states to reduce emissions.

In November 2006, an amended petition was filed on behalf of 13 Canadian municipalities, towns, and health boards with the same allegations but with updated climate change and other research.

In addition we submitted comments in August 2007 to the US EPA in opposition to propose changes to the "New Source Review" law under the Clean Air Act which would allow for additional increases in emissions from US coal fired power plants to the detriment of Canada.
