Defending the rights of Sharbot Lake protestors

Clinic lawyers successfully defended activist demonstrating against controversial uranium mine in eastern Ontario [July 2008]


On behalf of environmental advocates who were campaigning to reform Ontario's antiquated Mining Act and against uranium exploration and mining in Eastern Ontario, lawyers from the uOttawa-Ecojustice Environmental Law Clinic represented an individual charged with contempt of court.

The proceeding was treated as a SLAPP suit, intended to silence activists who were demonstrating at the gate of a controversial proposed mine site at Sharbot Lake, 30 kilometres west of Perth, Ontario.

Clinic Director, lawyer Linda McCaffrey was was assisted by University of Ottawa Associate Professor, Graham Mayeda, a criminal law specialist.

The mining company capitulated just prior to the hearing, agreeing to an order of dismissal of the charges.

Another group of citizens (the “Robertsville 5”) were more recently charged with contempt, and the Clinic successfully defended them as well.
