Ecojustice's legal and scientific work to ban PBDEs in Canada

In February 2007, Ecojustice submitted a Notice of Objection to a proposed regulation under the Canadian Environmental Protection Act. The regulation proposed to only ban lower brominated Polybrominated Diphenyl Ethers (PBDEs), which have been more or less phased out voluntarily by industry.

The proposed regulation did not ban the most prevalent BFRs in use including decaBDE. The notice argues that the government has failed to act according to its legal requirements and provides new evidence that decaBDEs bioaccumulate and debrominate, which was not previously considered by the government.

We are still awaiting a decision from the Minister.
