Why Manitobans would benefit from a cosmetic pesticide ban

In our letter to Manitoba's Minister of Conservation and Water Stewardship, we says it's time to stop exposing people, pets and the province's lakes and rivers to the harm posed by pesticides.

Today a coalition of health and environmental groups from across Canada urged the Manitoba government to protect the health of its communities with a province-wide, cosmetic pesticide ban. 

We addressed our letter to the Honourable Gord Mackintosh, Manitoba’s Minister of Conservation and Water Stewardship, who recently took an important first step toward banning cosmetic pesticides by releasing a discussion paper entitled Play it Safe; A Consultation on Cosmetic Law Pesticides. Pesticides used on lawns and gardens for cosmetic purposes expose people, pets and Manitoba’s lakes and rivers to unnecessary and potentially serious harm. 

Groups that signed the letter included Ecojustice, the Canadian Association of Physicians for the Environment, the Registered Nurses Association of Ontario, the Ontario College of Family Physicians and many others. 

Scientific research overwhelmingly shows that exposure to many pesticides poses serious health risks, including cancer risks among children, as well as reproductive and respiratory problems.  

PROTECTING OUR MOST VULNERABLE

Children face the greatest risks from pesticide exposure because they are closer to the ground and because their bodies are still developing.  Pesticides can also pose risks to drinking water, as well as fish and wildlife populations.

ALL ABOARD THE PROGRESS TRAIN

Many municipal and six provincial governments across Canada have already reduced that harm, banning the use of non-essential pesticides from lawns, gardens and public parks. Governments have an important role to play in helping Canadians to protect themselves from toxics, and Ecojustice is pleased that the Manitoba government is considering its own ban.  

Providing Manitobans with the same protections from exposure to harmful non-essential pesticides that most other Canadians enjoy is the right move. Manitoba families, as well as rivers, streams, and lakes such as Lake Winnipeg, deserve protection.

In our joint letter, the coalition urged the Manitoba Government to take a science-based, precautionary approach and to enact legislation that:

  • prohibits the use, sale, and retail display of chemical pesticides for lawns, gardens, and non-agricultural landscaping;
  • allows for exemptions to the ban only where necessary to protect public health;  
  • provides for public education about the ban and alternatives to chemical pesticides; and
  • includes effective mechanisms for enforcement.

OUR VISION

We look forward to a future where Manitoba’s most vulnerable, children, are no longer exposed to harmful chemicals while playing on lawns or in parks.

It is great that you are trying to get the cosmetic pesticides ban extended in Manitoba. However, here at home in Ontario - where there is a cosmetic pesticides ban - the Ministry of Environment still allows by permit the use of the highly-regulated, restricted pesticides Diquat and Copper Sulphate in privately and commonly owned lakes/ponds in Lakeland Estates, Greely, as long as the majority of owners want to use the pesticides and they are closed lakes. Is there anything that can be done about this?

Hi Chris,

Thank you for contacting us about your concerns regarding the use of pesticides such as diquat and copper sulphate in Ontario lakes. Diquat is an active ingredient in two herbicides (one is a Class 3 pesticide and the other is in Class 4). These herbicides are banned for cosmetic use in, on, or over land in Ontario unless an exception applies. Polydex (copper sulphate algaeside) is categorized as a Class 4 pesticide in Ontario. According to the Ontario Ministry of the Environment, Class 4 contains “less and least hazardous commercial or restricted pesticides that can continue to be used under an exception to the ban.”

Our understanding of the situation in Lakeland Estates is that permits for the application of diquat and copper sulphate in the lakes and ponds at issue were issued under subsection 7(2) of Ontario’s Pesticides Act. This provision deals with water exterminations, which are defined in section 1 of the Act as “the destruction, prevention or control in, on or over surface water of a pest by the use of a pesticide.”

One provision that you may be interested in reviewing is subsection 11(3) of the Pesticides Act, which provides the Director with the discretion to refuse to issue a permit, or to cancel a permit where certain conditions are met, such as where the Director is of the opinion that “there is or is likely to be impairment of the quality of the environment for any use that is being or is likely to be made of it” or that “a different method of control or extermination will or will likely be substantially as effective as the proposed extermination for which a permit is required under section 7 and will or will likely cause less impairment of the environment…”. In the last decade, ALL PROVINCIAL PROHIBITIONS against pest control products have been 100 per cent Politically-Based and 0 per cent Science-Based.

In 2011, the PROVINCE OF ALBERTA STOPPED the trend towards NEEDLESS, SENSELESS, and MALICIOUS PROHIBITION.

On August 9th, 2011, the GOVERNMENT OF ALBERTA stated that it WILL NOT CREATE RESTRICTIONS OR LAWS THAT CONFLICT WITH THE FEDERAL GOVERNMENT, that is relied upon for health and safety assessments.

Consequently, the GOVERNMENT OF ALBERTA has indicated that is has NO INTENT TO PROHIBIT THE SALE OF ANY PEST CONTROL PRODUCT.

ALBERTA has monitored Anti-Pesticide PROHIBITIONS over the past few years and the approaches taken by other jurisdictions, and has found THE BASIS FOR ACTION CONFUSING AND INCONSISTENT.

More recently, British Columbia’s Special Committee On Cosmetic Pesticides announced that it WILL NOT RECOMMEND PROHIBITION against the use of pest control products in the Urban Landscape.
